Terms of Service & End User License Agreement

DEFSCAN PROFESSIONAL IS PROVIDED FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. THIS SOFTWARE DOES NOT GUARANTEE COMPLETE SECURITY, PREVENT CYBERATTACKS, OR REPLACE PROFESSIONAL SECURITY SERVICES.

1. ACCEPTANCE OF TERMS

By purchasing, downloading, installing, or using DEFSCAN Professional ("Software"), you agree to be bound by these Terms of Service and End User License Agreement ("Agreement"). If you do not agree to these terms, do not use the Software.

2. LICENSE GRANT

Subject to your compliance with this Agreement, Scan2Secure grants you a limited, non-exclusive, non-transferable, revocable license to use the Software solely for your internal business purposes on the number of devices specified in your license purchase.

3. DISCLAIMER OF WARRANTIES

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

SCAN2SECURE EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY, RELIABILITY, OR COMPLETENESS OF RESULTS
  • DETECTION OF ALL SECURITY VULNERABILITIES
  • PREVENTION OF SECURITY BREACHES OR CYBERATTACKS

4. LIMITATIONS OF USE

The Software SHALL NOT be used for:

  • Compliance Audits: The Software is not certified for regulatory compliance audits (PCI DSS, HIPAA, SOC 2, etc.)
  • Legal Evidence: Results cannot be used as evidence in legal proceedings
  • Law Enforcement: Not suitable for forensic or law enforcement purposes
  • Critical Infrastructure: Not intended for systems where failure could result in death, injury, or significant property damage
  • Unauthorized Testing: Must not be used to scan systems you do not own or have explicit permission to test
  • Malicious Purposes: Any use intended to harm, disrupt, or gain unauthorized access to systems

5. EDUCATIONAL PURPOSE NOTICE

DEFSCAN Professional is designed for EDUCATIONAL and AWARENESS purposes.

The Software:

  • Provides general security awareness and education
  • Identifies potential common vulnerabilities
  • Offers general remediation suggestions
  • Does NOT fix or remediate security issues
  • Does NOT replace professional security assessment
  • May NOT detect all security vulnerabilities
  • May produce false positives or false negatives

6. PROFESSIONAL SERVICES DISCLAIMER

IMPORTANT: Security vulnerabilities identified by this Software should be:

  • Evaluated by qualified cybersecurity professionals
  • Fixed by qualified IT professionals
  • Verified through professional security testing

Scan2Secure does not provide security consulting, remediation services, or professional advice. Users are solely responsible for engaging qualified professionals to address security issues.

7. LIMITATION OF LIABILITY

IN NO EVENT SHALL SCAN2SECURE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Security breaches or cyberattacks
  • Failure to detect vulnerabilities
  • False positives or false negatives
  • Actions taken based on Software results
  • Damages exceeding the amount paid for the Software

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Scan2Secure and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use or misuse of the Software
  • Your violation of this Agreement
  • Your violation of any law or third-party rights
  • Any actions taken based on Software results

9. LICENSE RESTRICTIONS

You may NOT:

  • Reverse engineer, decompile, or disassemble the Software
  • Modify, adapt, or create derivative works
  • Rent, lease, lend, sell, redistribute, or sublicense the Software
  • Remove or alter any proprietary notices
  • Use the Software to develop competing products
  • Share license keys with unauthorized users

10. TERMINATION

This Agreement is effective until terminated. Your rights automatically terminate if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Software and destroy all copies.

11. REFUND POLICY

Due to the digital nature of the Software and immediate delivery of license keys, we do not offer standard refunds. However, if you experience technical issues that prevent the Software from functioning as intended, we will work with you to resolve the issue until you are satisfied. If the Software cannot be made to work as intended despite our reasonable efforts, we will provide a refund subject to verification of the technical issues and evidence of the problems encountered. All refund requests must be made within 7 days of purchase.

12. GOVERNING LAW

This Agreement shall be governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Delaware.

13. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and Scan2Secure regarding the Software and supersedes all prior agreements and understandings.
